These Terms of Service (“Terms”) govern your access to and use of the website located at flyvirga.com and the Fly Virga mobile application (collectively, the “Service”) provided by Aviation Apps, LLC (“Company,” “we,” “us,” or “our”), a Colorado limited liability company with its principal place of business at 251 Stone Pointe Trl, Castle Rock, CO 80109.

By accessing or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, do not access or use the Service.

1. Eligibility

You must be at least 18 years of age and have the legal capacity to enter into a binding agreement. The Service is intended for use by licensed pilots or other individuals authorized under applicable regulations to submit Pilot Reports (PIREPs). By using the Service, you represent and warrant that you meet these eligibility requirements.

2. Description of the Service

Fly Virga is a mobile application and related website that allows users to create, submit, view, and interact with Pilot Reports (PIREPs). Key features include:

• Submitting PIREPs (including optional photos) while airborne or on the ground
• Transmitting submitted PIREPs to the Aviation Weather Center (aviationweather.gov) for potential inclusion in the official FAA/NWS system
• Viewing PIREPs submitted by other users and those originating from the official Aviation Weather Center system
• Map-based viewing, geographic and altitude-based alerts, and limited social features (following other users, liking, and commenting)

The Service is provided as a convenience tool to encourage more frequent and detailed PIREP reporting in support of aviation safety.

3. Account Registration and Security

To use most features of the Service, you must create an account and provide accurate, current, and complete information, including your name, email address, call sign, and aircraft details (make/model and N-number). You may associate multiple aircraft with your account.

You are solely responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account. We reserve the right to suspend or terminate accounts that appear to be compromised or used in violation of these Terms.

4. User Responsibilities and Acceptable Use

You agree that:

• You are solely and fully responsible for the accuracy, completeness, truthfulness, and appropriateness of every PIREP you submit.
• You will only submit legitimate observations of actual conditions encountered during flight or related operations.
• You will not submit false, misleading, fabricated, exaggerated, or incomplete reports.
• Photos attached to PIREPs must accurately depict the conditions being reported and must not contain illegal, offensive, or irrelevant content.
• You will not use the Service to interfere with, disrupt, or overload the Service or any connected systems (including the Aviation Weather Center).
• You will not attempt to reverse engineer, scrape, or misuse data from the Service.

Submitting inaccurate or false PIREPs can have serious safety and legal consequences. Aviation Apps, LLC does not review, verify, edit, or approve the content of user-submitted PIREPs before transmission.

5. Relationship with Official Aviation Systems

The Service is an independent third-party tool. Aviation Apps, LLC is not affiliated with, endorsed by, sponsored by, or an official partner of the Federal Aviation Administration (FAA), National Weather Service (NWS), Aviation Weather Center (AWC), Leidos, or any government agency.

Transmission of a PIREP through the Service does not guarantee that the report will be accepted, processed, displayed, or disseminated by the official Aviation Weather Center or any other system. You remain fully responsible for complying with any official reporting requirements that may apply to you as a pilot.

6. Intellectual Property and License to User Content

The Service, including its software, design, text, graphics, and other content created by us, is owned by Aviation Apps, LLC or its licensors and is protected by intellectual property laws.

By submitting content (including PIREPs, photos, comments, and profile information) to the Service, you grant Aviation Apps, LLC a worldwide, non-exclusive, royalty-free, perpetual, irrevocable, and transferable license to use, reproduce, modify, adapt, publish, transmit, display, distribute, and otherwise exploit that content for the purposes of operating, improving, and promoting the Service, and for transmitting reports to the Aviation Weather Center and displaying them to other users.

7. Disclaimers

THE SERVICE IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

AVIATION APPS, LLC DOES NOT WARRANT THAT:

• The Service will be uninterrupted, timely, secure, or error-free
• Any PIREP will be successfully transmitted to or accepted by the Aviation Weather Center
• Information displayed in the Service (whether user-generated or from official sources) is accurate, complete, reliable, or current
• The Service is suitable for making any flight planning, operational, or safety-related decision

You are solely responsible for all decisions related to flight planning, weather assessment, and aircraft operations. The Service is a supplemental tool only and is not a substitute for official weather briefings, air traffic control communications, approved weather sources, or your own professional judgment as a pilot.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, AVIATION APPS, LLC AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATED TO:

• Your use of (or inability to use) the Service
• Any PIREP you submit or view
• Any decision made in reliance on information obtained through the Service
• Any failure of a PIREP to reach or be accepted by the official system
• Any other matter relating to the Service

IN NO EVENT SHALL THE TOTAL LIABILITY OF AVIATION APPS, LLC ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICE EXCEED ONE HUNDRED U.S. DOLLARS ($100.00).

Some jurisdictions do not allow the exclusion or limitation of certain damages. In such jurisdictions, the above limitations shall apply to the fullest extent permitted by law.

9. Indemnification

You agree to indemnify, defend, and hold harmless Aviation Apps, LLC and its officers, directors, employees, agents, and affiliates from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising out of or related to:

• Your use of the Service
• Any PIREP or other content you submit
• Your violation of these Terms
• Your violation of any applicable law or regulation
• Your violation of any third-party rights

10. Termination

We may suspend, restrict, or permanently terminate your access to the Service at any time, with or without notice, for any reason, including if we believe you have violated these Terms. Upon termination, your right to use the Service immediately ceases. Provisions of these Terms that by their nature should survive termination (including ownership, disclaimers, limitation of liability, and indemnification) will survive.

11. Governing Law and Dispute Resolution

These Terms are governed by and construed in accordance with the laws of the State of Colorado, without regard to its conflict of law principles. Any legal action or proceeding arising under these Terms shall be brought exclusively in the state or federal courts located in Douglas County or Denver County, Colorado, and you hereby consent to the personal jurisdiction and venue of such courts.

12. Changes to These Terms

We reserve the right to modify these Terms at any time. When we make material changes, we will update the “Last Updated” date at the top of this page. Your continued use of the Service after any changes constitutes your acceptance of the revised Terms.

13. General

If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions will remain in full force and effect. Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. These Terms constitute the entire agreement between you and Aviation Apps, LLC regarding the Service and supersede any prior agreements.
