Aviation Apps, LLC (“Company,” “we,” “us,” or “our”), a Colorado limited liability company with its principal place of business at 251 Stone Pointe Trl, Castle Rock, CO 80109, operates the website flyvirga.com and the Fly Virga mobile application (collectively, the “Service”).

This Privacy Policy explains how we collect, use, share, retain, and protect information when you access or use the Service. By using the Service, you agree to the collection and use of information in accordance with this Privacy Policy.

A. Information You Provide Directly

• Account and profile information: name, email address, call sign, profile photo (optional), and other details you choose to provide.
• Aircraft information: aircraft make, model, and N-number (you may associate multiple aircraft with your account).
• PIREP content: location (including precise GPS coordinates when available), altitude or flight level, time of observation, weather observations (such as turbulence, icing, visibility, cloud cover, temperature, winds, etc.), free-text remarks, and any photographs you attach to a report.
• Communications: information you provide when you contact us, subscribe to updates, or interact with support.

B. Information Collected Automatically

• Device and usage information: device type, operating system, unique device identifiers, IP address, app version, crash data, and how you interact with the Service (features used, pages viewed, time spent, etc.).
• Location data: approximate or precise location information when you use map, alert, or PIREP submission features (with your device permission).
• Log and diagnostic data related to the performance and security of the Service.

C. Information from Social Features

• Follow relationships, likes, comments, and alert preferences you set within the app.

We do not knowingly collect personal information from children under the age of 13. If we learn that we have collected such information, we will delete it promptly.

2. How We Use Your Information

We use the information we collect to:

• Provide, operate, maintain, and improve the Service
• Enable you to create, submit, view, and interact with PIREPs
• Transmit your submitted PIREPs to the Aviation Weather Center (aviationweather.gov) for potential inclusion in the official FAA/NWS system
• Display PIREPs (both user-submitted and those originating from the official system) to other users of the Service
• Send push notifications for geographic or altitude-based alerts you configure
• Communicate with you about the Service, including updates, security alerts, and support
• Monitor usage, diagnose technical issues, and improve performance and security
• Detect, prevent, and address fraud, abuse, or violations of our Terms of Service
• Comply with applicable legal obligations

3. How We Share Your Information

We may share information in the following circumstances:

• Aviation Weather Center / Official Systems: When you submit a PIREP, we transmit the report and the associated data required by the system to the Aviation Weather Center so that it may enter the official FAA/NWS aviation weather system. Once transmitted, that data becomes subject to the policies and public nature of the official system.
• Other Users of the Service: PIREPs you submit (including photographs and remarks), certain profile information, likes, and comments may be visible to other users of the Fly Virga app.
• Service Providers: We share information with trusted third-party service providers who assist us with hosting, data storage, analytics, push notifications, and other operational needs. These providers are contractually required to protect the information and use it only for the purposes we specify.
• Legal and Safety Reasons: We may disclose information if required by law, subpoena, court order, or governmental request, or if we believe in good faith that disclosure is necessary to protect the rights, property, or safety of Aviation Apps, LLC, our users, or the public.
• Business Transfers: In the event of a merger, acquisition, reorganization, or sale of assets, your information may be transferred as part of that transaction.

We do not sell your personal information.

4. Data Retention

We retain your account and profile information for as long as your account remains active or as needed to provide the Service. When an account deletion request is processed, personal data is permanently removed from our active production databases. Residual data contained within encrypted disaster-recovery backups is isolated and automatically purged as backup retention cycles expire (typically within 30 to 90 days).

PIREP data that has been transmitted to the Aviation Weather Center is retained according to the practices of the official system. We may retain certain information longer if necessary to comply with legal obligations, resolve disputes, enforce our agreements, or for legitimate business purposes such as security and fraud prevention.

5. Your Choices and Rights

You may:

• Access and update certain account and profile information directly within the app
• Request deletion of your account and personal data at any time directly in the app or via our Account & Data Deletion Page (subject to our retention obligations)
• Control location permissions and notification settings through your device settings
• Opt out of non-essential communications

6. Security

We implement reasonable administrative, technical, and physical safeguards designed to protect the information we collect. However, no method of transmission over the Internet or method of electronic storage is completely secure. You are responsible for maintaining the security of your account credentials.

7. Third-Party Services and Links

The Service may contain links to or integrate with third-party websites or services, including the Aviation Weather Center. We are not responsible for the privacy practices or content of those third parties. We encourage you to review their privacy policies.

8. International Users

The Service is operated from the United States. If you access the Service from outside the United States, please be aware that your information may be transferred to, stored, and processed in the United States, where data protection laws may differ from those in your country.
